a local lady has probems and is on the list waiting for a new kidney. to help offset expences a local watering hole holds a benifit w/live bands every couple months with all the profits going to help pay her expences. i have been approached and ask to donate a 6 pack of HB for them to sell chances for and i have agreed. but the thought has occured that it might be illegal. simply 'cause somebody's going to get money for it, however indirectly. now i'm not worried about me, 'cause i'm giving it away. however i'd hate for friends to get in trouble just trying to do a good thing.

That is a tough one Jim, but I think if they make it very clear that you must be 21 + to bid that may cover the legalities.

Georgia law according to AHA says this:

"(e) Malt beverages produced pursuant to this code section shall not be sold, offered for sale, or made available for consumption by the general public.""

So illegal it is... who get the blame I dunno. If anyone cares enough to actually care enough to go after them... I dunno.

This does make it pretty clear, and if they're advertising it in any way, it could cause trouble for someone (or a few someones).

The only loophole I can see is offering some other goods or service and "throwing in" the six-pack, although that can't be advertised either.

i told them to not advertise this, if they listen or not... people get in trouble and arrested for way dumber stuff. i.e. the lady in texas(i think it was) who was arrested for letting her kid play in her own yard un-supervised. even though she was right there sitting in a lawn chair. or the 2 kids who got expelled for playing with nerf guns at home during non-school/bus hours. and the list goes on and on.

You can be held responsible if your brew is consumed by someone that then gets in an accident, just like if they were in your home and you served them alcohol.

I'm not a lawyer, but I'd suggest a short note that an owner of the bar signs:

"We graciously accept your donation for our charity event and agree to hold you harmless from any and all claims that might be made".

I would do it. I'm aware of all of the craziness in courts. I have been sued at work. I still always told my cops that if you do the right thing for the right reason, even if it was outside procedure, then you won't be afraid to stand in court or anywhere else and defend your conduct. Besides, how likely is it that the liquor agency will monitor a charity event?

On another board someone was asking about charity brews and a novel suggestion was posted. Offer up a case of homebrew including lessons. The person purchasing would do the actual brewing under supervision. You might even be able to convince MrB or a LHBS shop to kick in a small vessel or pick one up online. The last one I picked up was $2.

I did the exact thing last year for a charity event at work. The raffle was for the opportunity to brew a case of beer of the winners choice. It was a great deal, I, I mean we , did a 5 gallon batch. He got a case and I got a case. No biggie. But at least this was limited to people I work with, so I was comfortable having the winner at my place to so this. Your case may be different since it's a local bar and who knows who would win!!!
